One of our clients had a vigorous negotiation with a CEO candidate (or at least his very aggressive lawyer). When it came time to sign, with the contract on the table and the pen in his hand, the would-be successor said to the director who was leading the search, “I just want you to know that I am being advised that I am leaving a lot on the table and would like you to consider improvements to my terms.” The response of the director—who for many reasons had been given a great deal of authority over the process—was “Don’t bother to sign . . . our offer is withdrawn.” It would have been a real problem if there had been an announcement, at least in this case, simply on the basis of a term sheet.
